The famous Brazilian football team Flamengo has just obtained an important decision in Paraguay, in a dispute challenging the registration of the CRF FLAMENGO mark filed by a Paraguayan citizen for sporting goods, without the proper authorization or license from the Brazilian entity. Represented by the Law Firm of Montaury Pimenta, Machado and Vieira de Mello, the Rio de Janeiro entity filed the appropriate legal measures in Paraguay to challenge this application in Paraguay.
"The legislation of most countries prohibits the registration of famous or highly reputed brands on behalf of third parties. The fact that the Rio entity acted preventively and took the appropriate legal measures in a timely manner was essential to repress the attempt to register this trademark by the aforementioned Paraguayan citizen, which could lead to a dangerous manufacture and sale of pirated sporting goods in Paraguay, with possible consequences (counterfeiting) for neighbor countries", said Claudia Zeraik, partner at Montaury Pimenta Machado & Vieira de Mello.
