 News on Patent Law in Paraguay
Presidential Decree No. 8069 was issued on December 23, 2011, which complementary regulates the Patent Law No. 1630/2000 and its modification Law No. 2593 of 2005.

The main novelty in the above regulation is the method of intervention of the Ministry of Health in the examination of pharmaceutical patents. Pursuant to Article 10 of the Decree, the Directorate of the Ministry of Health will have 100 days, once the file from the Patent Office is received, to issue its opinion regarding the patent.

This opinion is independent of the opinion issued by the Patent Office.

The Applicant, in case of objections to the invention, will have to answer each of the opinions issued by those offices (Patent Office and Ministry of Health).
