The Director General of the World Intellectual Property Organization (WIPO) presented his compliments to the Minister for Foreign Affairs of Paraguay after the deposit by Paraguay, on May 5, 2023, of its instrument of accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure.
It will enter into force on Paraguay on August 5, 2023.
The Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure is an international treaty that was signed in Budapest, Hungary, on April 28, 1977. It entered into force on August 19, 1980, and was later amended on September 26, 1980.
It is designed to simplify the process of obtaining patent protection for inventions that involve microorganisms. Under the treaty, a deposit of a microorganism with an international depositary authority (IDA) is recognized as equivalent to a deposit with the national patent office of each contracting state. This means that an applicant for a patent can deposit a microorganism with a single IDA, and the deposit will be recognized by all contracting states.
The Budapest Treaty has been ratified by 128 countries and it has been a valuable tool for facilitating the patenting of inventions that involve microorganisms. It has saved applicants time and money, and it has helped to ensure that patent protection is available for these inventions in all contracting states.
