Argentina Updates Trademark Examination Procedure to Speed Up Registrations

The National Institute of Industrial Property (INPI) has approved Resolution RESOL-2025-583, which modernizes the trademark registrability procedure with the aim of making it simpler, faster, and more predictable. This update strengthens legal certainty for entrepreneurs, professionals, and companies, supporting productive development throughout the country.
The measure brings the trademark examination process into alignment with international standards and provides that, for new trademark applications, the analysis will be limited to absolute grounds of non-registrability and matters related to public order. Relative grounds — such as similarity with earlier trademarks or issues of a private nature — will be evaluated only at the request of a party, through the opposition mechanism provided for in Law 22.362.
In addition, the update establishes that the formal examination and registrability review will take place immediately after the application is submitted and before its publication, provided it meets the necessary conditions to proceed. If no objections are found, the trademark will be published for one day in the Trademark Bulletin, and, after 30 days without oppositions, it will be granted.
The new process will apply to all ongoing applications and will come into effect in a staggered manner: the changes related to the scope of examination will take effect from the publication of the resolution, and the new procedural stages will apply beginning March 1, 2026.
