Changes to the Patent Law in Uruguay

The aforementioned article 99 currently states that the owner of a patent may start legal actions against whoever performs acts that infringe its rights. The amendment included in the bill establishes that the owner of a patent also can claim compensation for “those acts carried out between the publication of the application and the granting of the patent”. When the right belongs to several holders, any of them may initiate those legal actions.
The bill is currently under study by the Congress for its approval.
