Colombia Establishes New Requirements for Holographic Trademark Applications
By Castillo Grau Abogados

The Superintendence of Industry and Commerce has issued new rules specifying how holographic trademarks must be represented in applications, including an animated file, graphic or photographic images, and a detailed description of the sign.
Colombia is updating its industrial property framework to address the particular characteristics of holographic trademarks. Through Resolution No. 82923 of October 19, 2026, the Superintendence of Industry and Commerce (SIC) introduced specific requirements for representing these non-traditional signs in trademark applications.
The resolution adds section 1.2.5.20 to Chapter One of Title X of the SIC’s Sole Circular. Applicants must provide a representation that clearly identifies and defines the holographic effect for which protection is sought, including its perceptible visual variations.
Under the new rules, applications must include three elements: an animated reproduction without sound in MP4 format, with a maximum file size of 50 MB; a graphic or photographic reproduction comprising the views, images or sequences necessary to identify the holographic effect in its entirety; and a clear, precise and complete description of the sign and its visual characteristics.
The relevant electronic files must be attached to the application and submitted exclusively through the Industrial Property Information System (SIPI), the SIC’s electronic filing platform.
The requirements are intended to ensure that the subject matter of protection can be clearly identified and delimited. A sufficiently clear representation is particularly important for non-traditional trademarks, as it enables third parties to understand the sign claimed and assess whether to oppose its registration.
The resolution forms part of Colombia’s efforts to modernize its industrial property system in response to the evolution of distinctive signs and the growing use of unconventional visual effects to identify products and services.
The new provisions are scheduled to enter into force on January 1, 2027.
