Confusing search-engine keywords ads

American online retailer of prescription glasses Warby Parker was sued by contact lens retailer 1-800 Contacts for trademark infringement, according to a complaint presented on the U.S. District Court for the Southern District of New York.The sue states that Warby Parker purchased search-engine keywords ads for 1-800 Contacts to misdirect customers to its competing online contact-lens store, which also copied the design of 1-800 Contacts store to further confuse customers who click the infringing ads. According to the complaint its a devised a plan to confuse consumers in an inherently unfair and unlawful manner.
"Warby Parker's plan intentionally deceives and confuses consumers, who have a reasonable and legitimate expectation that their searches for the well-known 1-800 Contacts trademarks will lead them to 1-800 Contacts' website, products, and services, not to a page created by a competitor," the complaint says.
