Disney sued by Starz in Latin America
Starz, a Lions Gate Entertainment company, has filed lawsuits in Argentina, Brazil and Mexico against The Walt Disney Company, claiming the release of Disney’s new Star+ streaming service in Latin America infringes its StarzPlay trademark.Starz’ streaming service StarzPlay is available in Latin America since 2019, according to the lawsuit.
“Disney’s decision to launch a standalone general entertainment streaming service under the name Star+ and rename its existing channels to Star in Latin America -despite the prior existence of and trademark registrations for Starz’s own similarly named StarzPlay general entertainment streaming service- is extremely likely to cause customer confusion in the Latin American marketplace and infringes on Starz’s marks,” the lawsuit states.
On June 25, 2021, Disney was favored in one of the three countries: a ruling by the Court of Justice of Sao Paulo, Brazil, stated that the use of the Star trademark isn’t a violation of the rights arising from the Starzplay trademark.
