Ecuador: Regulatory Reform on Technology Free Zones

The government of Ecuador, through Executive Decree 387 issued on May 18, 2026, amends the Regulations of the Organic Law on Economic Efficiency and Employment Generation, with the objective of strengthening free zones and promoting the development and export of technology services.
Key aspects of the reform:
Technology Free Zones Promotion: The reform introduces the category of industrial free zones for technology services, covering activities such as data processing and management, telecommunications, and scientific and technological research.
Expanded Definition of Technology Activities: The decree prioritizes areas including artificial intelligence, software development, nanotechnology, cybersecurity, biotechnology, and video games.
Employment Generation Requirement: Projects that do not create jobs will not be approved.
Labor Flexibility: The reform incorporates remote work arrangements, with a mandatory minimum on-site presence of 51% per month, facilitating the export of digital talent.
Customs Facilities: The decree allows the import and export of computer equipment and digital tools under simplified control systems.
