Electoral Tribunal dismisses lawsuit regarding AMLO

The Electoral Tribunal of the Federal Judiciary of Mexico dismissed a lawsuit regarding the use of the trademark AMLO, registered by Mexican president Andrés Manuel López Obrador.In September 2020 López Obrador and his wife, Beatriz Gutiérrez Müller, registered their names as a trademark for a period of 10 years before the Mexican Institute of Industrial Property (IMPI). The president and the writer may use their name as a trademark for products and services for the purposes of advertising, business management, business administration and office work.
During the last months the AMLO trademark was used by Juntos Hacemos Historia, a Mexican electoral alliance formed among others by López Obrador’s political party MORENA to compete in the June 2021 legislative election.
Two of Juntos Hacemos Historia rivals -conservative political party PAN and social democratic political party PRD- claimed before the National Electoral Institute that such use of the trademark was “intentional, systematic and illegal” as it looked to favor Juntos Hacemos Historia candidates by linking them to López Obrador.
However, the Electoral Tribunal of the Federal Judiciary stated that it could not rule on the matter as the lawsuit argued that the trademark AMLO was used for purposes other than those established by IMPI, therefore the complaint should be presented before IMPI and not to venue specialized in electoral matters.
