Electronic Commerce Law

The Electronic Commerce Law entered into force in El Salvador on February 10, 2021, establishing the legal framework for all commercial relationships undertaken and contracts executed through digital or electronic means.In the last years El Salvador has continued to use the internet to convey information, promote commerce, reduce bureaucracy and improve services to the public. After being approved by Congress in October 2019, the Electronic Commerce Law
was published on the Official Gazette in February 2020.
According to the new law, the relationship between the consumer and online provider will be regulated according to the Consumer Protection Law, and it includes provisions not to violate users' rights. The regulation will be applicable "to any natural or legal person, public or private, established in El Salvador.
The COVID-19 pandemic has triggered e-commerce throughout the country, and last year the Ministry of Government launched a virtual platform called Market SV to facilitate the marketing of products, services between suppliers and consumers to boost the economy and promote micro, small and medium-sized companies (MSMEs) which have been affected by the coronavirus.
The Electronic Commerce Law goes in line with other legal tools such as the Electronic Signature law, was passed in 2015, which facilitates business and commerce through internet-based transactions. Per the legislation, the certified electronic signature is equivalent to an ink signature.
