Plaintiff Coral Castle, Inc. (CCI), a Florida corporation which owns a historic and tourist attraction called Coral Castle, sued gaming company Epic Games, Inc. for trademark infringement.According to the lawsuit, Epic Games infringed on two of its trademarks by naming Coral Castle one of the fictional gaming locations of its highly popular video game Fortnite.
CCI argued that Epic Games has caused harm by utilizing the vast goodwill associated with its trademarks to promote Fortnite and the sale of in-game purchases without CCI’s consent, causing blurring or confusion to the public as to the existence of an affiliation between Fortnite and CCI.
