This is to follow up regarding the current situation affecting Guatemala. Please review the following updated information:
a. The Intellectual Property Registry remains open to the public as of April 13, 2020 until otherwise decided by the authorities.
Trademark applications and other related applications, as well as certain types of resolutions may be notified or served on an ad-hoc basis. Legal terms following any decision or act by the PTO remain suspended. Thus, should any ruling or resolution be served or notified, the legal term will be computed as from the date the suspension affecting said deadlines is formally revoked.
Notifications of new oppositions, as well as any resolution which triggers a legal term and affects third parties’ rights remain suspended until further notice.
b. Civil and labor courts will resume part of its activities as of April 28, 2020. Nonetheless, all activity is limited to matters of urgent nature or constitutional matter. (e.g. Pending hearings and outstanding notifications will remain suspended until further notice.)
c. Regarding the computation of the judicial terms and deadlines, all remain legally suspended (except from certain constitutional injunctive proceedings), all of which will be resumed as from the next business day following the government´s decision to end the public calamity legal status.
