GM and Ford fight for Cruise related trademark
By Ferraiuoli LLC
On July 2021, the General Motors Company filed a lawsuit with the U.S. District Court Northern District of California against Ford for violating a trademarked hands-free driving technology name Blue Cruise. The company says Ford's Blue Cruise name infringes on GM's Super Cruise trademark, used for its own hands-free, partially automated, driving technology.
"If Ford wanted to adopt a new, unique brand, it easily could have done so without using the word Cruise. Ford's decision to rebrand by using a core mark used by GM will inevitably cause confusion among consumers,” the lawsuit states.
Ford answered by asking the U.S. Patent and Trademark Office to rescind GM's Super Cruise trademark registration, as it “should have never been registered in the first place because many companies are using the word Cruise in connection with driver-assist technology”.
Awaiting the USPTO decision, GM said it "remains committed to vigorously” defend its trademark and protect the equity of products and technology earned over several years in the market.
