Hamilton International motion denied

The claim was against Vortic LLC, a watchmaker specializing in restoring antique pocket watches and then converting them into wristwatches, which produces the Lancaster, a wristwatch based on pocket watches that Hamilton produced in the 1900s.
According to the judge there are genuine disputes of material fact about both the presence of full disclosure and the applicable factors of the test used when determining if a likelihood of confusion exists in trademark cases. In this case “a reasonable factfinder could determine that no likelihood of confusion exists because Vortic has made a full disclosure that its Lancaster was a Hamilton”.
