Kellogg Takes Venezuela to Court Over
By Enrique Cheang, E.C.V. & Asociados
Kellogg Latin America Holding Company (One) Limited, a British subsidiary of the US food giant Kellogg's, filed a legal action against Venezuela in November 2023 at the International Centre for Settlement of Investment Disputes (ICSID). The case is registered as ARB (AF)/23/2.
The dispute centers around Kellogg's Venezuelan subsidiary, which alleges the government effectively expropriated its factory without formal seizure, then pilfered its trademarks for unauthorized production.
Citing international treaty guarantees, Kellogg demands compensation for what they deem an unfair land grab. With substantial damages potentially at stake, the battle promises a bitter fight over investment rights and the fate of a familiar breakfast symbol in Venezuela.
