In March a Salvadoran businessman applied for the registration of Mariguanol as a trademark to designate goods of class 5 of the Nice International Classification.

Mariguanol is a marijuana extract-based ointment commercialized in the informal market for pain relief of ailments such as arthritis, rheumatism, inflammation, neck pain and headache, among others.

The trademark application has already surpass two examination tests by the National Registry Center (CNR) and, if not trademark opposition proceedings are filed, the trademark could be legally registered on September.

In El Salvador the law doesn´t inhibit a trademark registration based exclusivelly on product characteristics purposes, therefore it compels the trademark application to indicate to which class the product belongs, but not its ingredients.

Nevertheless until today Mariguanol is sold illegally in the informal market since it´s not yet registered in the General Drugs Directory, which therefore has the legal power to seize the product. In addition, to obtain the registration by the General Drugs Directory, Mariguanol must prove that its ingredients genuinely produce medicinal benefits and aren´t consciously misleading consumers.
