No Salvaroran Registration

The Mexican company Cosmocel Sociedad Anónima applied to register the mark COSMOCEL & Design, for goods in Class 1. Arch UK Biocides Ltd. filed opposition, alleging that the applicant´s mark was similar to its trademark COSMOCIL, registered in many countries, including Guatemala, Panama and Colombia.

The Intellectual Property Department disagreed and denied Cosmocel’s opposition on the ground that the opposing mark was neither pending nor registered in El Salvador.

On the opponent’s appeal, the National Bureau of Registries confirmed the denial of the opposition.
