The Japanese company Ishihara Sangyo Kaisha Ltd. filed an application to register the trademark SURTON to protect goods in International Class 05. The Panamanian company Roemmers Internacional S.A. opposed this application due to the similarity of SURTON to its previously registered mark SURTONIL in the same class.

The National Bureau of Registries, on appeal, confirmed the resolution by the Intellectual Property Department, denying
the opposition based on a lack of similarity between the goods that are identified by the two trademarks, i.e., SURTONIL protects, specifically, a brain tonic and SURTON protects insecticides, fungicides and herbicides.
