No Similarity of Marks

Cadburry Adams USA LLC applied to register the mark CITRIC COCKTAIL, for goods un Class 30. Cadburry’s application was opposed by the Guatemalan company Exportadora Mercantil Agro-Industrial, S.A., which claimed that the applied-for mark was similar to its prior-registered trademark COCTEL, for goods in the same class. The Intellectual Property Department denied the opposition, and Cadburry appealed. The National Bureau of Registries confirmed the Department’s decision holding that the marks under comparison were not similar.
