No Similarity of Marks

Kentucky Fried Chicken International Holdings, Inc., filed trademark applications for CHICKY PACK and CHICKY COMBO, to protect goods in Class 29. The local company Avícola Salvadoreña, S.A. de C.V., filed opposition, arguing that the marks applied for were similar to its previously registered trademark CHICK’S, covering goods in the same class. The Intellectual Property Department denied the oppositions, holding the there was no similarity between the marks at issue. On appeal by Avícola Salvadoreña, the National Bureau of Registries confirmed the Department’s decisions.
