Peru Enforces Labeling Rules on Electronic Vapes in Peru

Peru’s National Institute for the Defense of Free Competition and the Protection of Intellectual Property (Indecopi) has carried out enforcement actions on the labeling of electronic vaping devices. The inspections led to suppliers incorporating essential information in Spanish regarding warnings and health risks associated with the use of these products.
In March 2025, inspections were initiated against 44 vape suppliers, reviewing hundreds of products to verify compliance with labeling regulations. The goal was to ensure that suppliers fulfilled their duty to provide accurate product information and that importers respected current labeling requirements.
The Directorate of Supervision (DFI) found that all companies inspected failed to comply with the obligation to provide information in Spanish on their product labels. After Indecopi’s intervention, the current progress was observed:
-77% of products now indicate in Spanish the substances or ingredients that may pose risks to consumers.
-73% include health warnings in Spanish regarding risks or dangers associated with product use.
-49% specify in Spanish the ingredients and details of the manufacturer, importer, or distributor in Peru.
-Labels provide additional details in Spanish, such as expiration date (34%), storage conditions (40%), and net content (32%).
Indecopi announced that it will continue monitoring compliance with labeling standards and will maintain permanent supervision until 100% of vape products comply with regulations.
The regulation of vaping products has become a growing public health and consumer protection issue across Latin America. Countries such as Mexico, Brazil, and Argentina have taken measures ranging from outright bans on sales to stricter regulation of labeling and advertising. Peru’s approach—focusing on compliance with clear labeling rules—seeks to balance market availability with the protection of consumers’ health and rights.
