Pharmaceutical chains banned for price fixing

Pharmaceutical chains banned for price fixing
Because of anticompetitive practices, the National Institute for Defense of Competition and Protection of Intellectual Property (Indecopi) of Peru fined five pharmacy chains and ordered them to implement several measures to avoid future recidivism.

Between January 2008 and March 2009, the chains Arcángel, Fasa, Inkafarma, Mifarma and Felicidad were found guilty of price fixing for 36 pharmaceutical related products from different brands. During that dates, 88% of Peruvian drug spending was made in pharmacies and pharmacy chains accounted for 72% of the sale of pharmaceutical products.

The five chains were fined with nearly USD 300.000 and must apply for three years a program of actions to prevent anticompetitive practices, such as personnel training on free competition rules and identifying the risks of non-compliance.
