Prohibited trademarks

This prohibition was subsumed in the general prohibition of Article 3, subsection d) of Law 22.362 on Trademarks and Designations, which forbids the registration of trademarks that can mislead or deceive the public.
However, last month, the National Institute of Industrial Property (INPI) adopted the resolution of specifically prohibiting the registration of any trademark, whatever its nature, which contains the terms “Light", "Milds", "Low-tar" and "Low-nicotine" or other similar ones, used alone, in combination with each other or combined with other words, to protect goods of Class 34 of the Nice International Classification (tobacco, smokers' articles and matches).
