Speed-up of patent application resolutions

The resolution compels applicants of patent applications filed before January 1, 2013, to state within 90 calendar days whether the priority claimed when filing the applications has been granted or not in the country of origin. If applicants fail to reply to the National Patent Administration, the application will become abandoned.
INPI´s main goal is to confirm interest of applicants in prosecuting further pending applications, since interest could have been lost because of elapsed time in proceedings, technology advances that turned obsoletetheir invention or other reasons.
INPI has already issued another identical regulation for the same purpose in 2008. Nevertheless delays subsist in technical-administrative procedures, producing various damages to patent applicants such as decrease in the useful life of their patents.
