Update on situation in Guatemala, Honduras and El Salvador

Guatemala

As from April 13, 2020, the Patent and Trademark Office remains open.

Legal terms following any decision or act by the PTO remain suspended. Notifications of new oppositions, as well as any resolution which triggers a legal term and affects third parties’ rights remain suspended.

Regarding the computation of the judicial terms and deadlines, all remain legally suspended (except from certain constitutional injunctive proceedings). The activity of civil and criminal courts is limited to matters of urgent nature or constitutional matter.

Honduras

Mandatory general closure remains until Sunday, May 17th, 2020.

The Honduran Trademark and Patent Office (PTO) continues to be closed. Therefore, all deadlines are in suspension.

Notwithstanding, as from April 27th, 2020, the filing of new trademark applications electronically is now available.

Regarding the computation of the judicial and administrative terms and deadlines, they remain suspended until May 17th, 2020.

El Salvador

The Intellectual Property Registry (PTO) remains close to the public until further notice. Currently, the PTO has an online system, which only allows for: requesting Trademark Search; Ownership Search; Request Reports; and Certifications and Copies.

Activities related to filing new trademarks, post – registry proceedings, opposition, and all other activities remain suspended until further notice.

Regarding the computation of the judicial and administrative terms and deadlines, 36/5000 the Legislative Assembly has approved an extension to the suspension until May 16, 2020.
