The National Directorate of Industrial Property (DNPI) of Uruguay has specified, with effect from January 7, 2025, the Spanish Patent and Trademark Office, in addition to the National Institute of Industrial Property (Brazil) and the National Institute of Industrial Property (Chile), as competente International Searching Authorities (ISAs) for international patent applications filed by nationals and residents of Uruguay with the DNPI as receiving Office.
Uruguay officially became bound by the Patent Cooperation Treaty (PCT) on January 7, 2025. This signifies a significant step in the country's integration into the global patent system. The PCT is an international treaty administered by the World Intellectual Property Organization (WIPO).
An ISA conducts a prior art search, which involves examining existing patents and publications to determine the novelty and inventive step of the invention described in the international applications.
The ISA provides an International Search Report (ISR) and a written opinion on the patentability of the invention. This report helps applicants assess the likelihood of obtaining patents in various countries, enabling informed decisions about pursuing patent protection in specific jurisdictions.
