Venezuela creates a Franchise Registration Service
By E.C.V. & Asociados
Venezuela created a Franchise Registration Service to facilitate the growth of this industry in the country and of Venezuelan brands abroad. The database will register franchisors, periodically update such list and prepare official analysis and statistics regarding their activity. The National Service for Intellectual Property (SAPI) will be working on the service to provide information on trademarks registrations and ongoing opposition cases.
Franchising is allowed in Venezuela under foreign investment laws. Franchise payments, royalties, patents, or technical assistance agreements must be registered and certain payments for the use of franchise rights may be subject to withholding taxes.
Historically, international franchises have enjoyed success in Venezuela. As of 2020, there were approximately 500 franchisors owning and operating 12,500 franchisee points throughout Venezuela, according to the Venezuelan Franchise Chamber.
