Wine Spectator against Weed Spectator

Created in 1976, Wine Spectator is a lifestyle magazine that focuses on wine and wine culture, and rates wines using a 100-point scale. In a complaint filed on 4 September 2018, the plaintiff accused Modern Wellness Inc for using and filing on 2 January 2018 two separate trademark applications which bear “striking similarities” to Wine Spectator’s own name and logo, and for rating cannabis by harvest with a familiar scale as the one of Wine Spectator.
“M. Shanken has no interest in associating Wine Spectator and the Wine Spectator marks with cannabis, a largely illegal drug. Any association of this type is likely to tarnish the reputation and goodwill that has been built up in the Wine Spectator marks and business for decades, resulting in dilution of the brand”, the complaint said.
