A trending topic within the intellectual property community involvers national IP offices loosening their requirements to allow foreign trademark applicants to file with-us engaging local counsel, versus maintaining, r even adding, such requirements. Just this past August, after decades without such a retirement, the United States Patent and Trademark Office (USPTO) issued a rule requiring foreign-domiciled applicants, registrants, and parties to the Trademark Trial and Appeal Board (TTAB) proceedings to be represented before the USPTO by an attorney who is licensed to practice law I the United States. This policy change was the subject of formal federal rule making that involved this cogitation of comments for stakeholders.
Join us to discuss why the USPTO went in this direction and made this significant change to its practice. The webinar will cover the requirements that must me met in order of a foreign domiciled applicant to file trademark applications, registration maintenance and renewals, and oppositions and petitions for cacenllation in the United States, as well as the effects the USPTO is seeing as a result of this new rule. We will also proved updates on new mandatory electronic filing rules and electronic login requirements before the USPTO.
